Situation Privacy Policy

This Privacy Policy (the "Policy") explains how Nibble Audio, Inc. ("Nibble Audio," "Company," "we," "us," or "our") collects, uses, shares, and protects information when you use the Situation mobile application and any related websites, features, and services (collectively, the "Services").

This Policy also explains your rights and choices and how you can contact us. Some features may be limited or unavailable in certain regions to comply with local law.

If you do not agree with this Policy, please do not use the Services.


1. What This Policy Covers

This Policy applies to information we collect:

  • when you create an account or use the Services,
  • when you create, publish, or join Situations,
  • when you interact with AI Characters and other users,
  • when you contact us or interact with our official pages on third-party platforms.

This Policy does not cover third-party websites, apps, or services that may be linked from the Services or that you use to access the Services. Those parties have their own policies.


2. Definitions

  • "Personal Data" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to an individual.
  • "User Content" means information and materials you submit to the Services, such as messages, prompts, titles, descriptions, images, and profile information.
  • "Generated Content" means content produced by the Services, including AI Character messages and outputs.
  • "Processing" means any operation performed on information, such as collection, storage, use, sharing, or deletion.

3. Information We Collect

We collect information from three sources: (A) information you provide, (B) information collected automatically, and (C) information from third parties.

A. Information You Provide to Us

Depending on how you use the Services, you may provide:

Account and profile information

  • email address, username/display name, profile photo (if any),
  • any optional profile fields you choose to add.

User Content

  • the Situations you create (including titles, descriptions, scenario text, character selections, and settings such as public visibility),
  • messages you send, prompts you enter, and interactions with AI Characters,
  • replies, reactions, reports, and other in-app submissions.

Communications

  • information you include when you contact us (for example, support requests), including message content and attachments.

Payments (if applicable)

  • purchases and subscription status.

We do not store full payment card numbers. Payment processing is handled by third-party payment processors (such as Apple or Google) and is governed by their policies.

Information about others

  • if you share content that includes information about others, you are responsible for ensuring you have the right to share it.

B. Information Collected Automatically

When you use the Services, we and our service providers may collect:

Device and technical data

  • device type, OS version, app version, language, time zone,
  • IP address, mobile carrier, and network information,
  • device identifiers and advertising identifiers (where available), such as IDFA or Android Advertising ID.

Usage and analytics data

  • screens viewed, features used, clicks/taps, session length,
  • interactions with Situations and AI Characters (for example, opening a Situation, sending a message, or creating a Situation),
  • performance and crash logs.

Approximate location

  • general location inferred from IP address (for example, city or region).

C. Information We Receive from Third Parties

We may receive information from:

  • App stores and platforms (for example, subscription status, receipts, and basic device/app diagnostics).
  • Advertising and analytics partners (for example, attribution data and campaign performance metrics).
  • Social media platforms if you interact with our pages or ads (for example, aggregated engagement metrics).
  • Referral sources if a user refers you (for example, referral codes or campaign identifiers).

4. How We Use Information

We use information for the purposes below. The specific purposes depend on how you use the Services.

A. Provide and operate the Services

  • create and manage accounts,
  • enable you to create, publish, join, and view Situations,
  • generate and display AI Character outputs,
  • personalize basic app behavior (for example, remembering settings).

B. Safety, moderation, and trust

  • detect, prevent, and investigate fraud, abuse, or harmful activity,
  • enforce our Terms of Service and policies,
  • review reported content and take action, which may include reviewing messages and prompts associated with a report or safety concern.

C. Improve and develop the Services

  • debug, test, and improve performance and reliability,
  • develop and improve features,
  • analyze product usage trends.

D. Communications

  • respond to support requests and user inquiries,
  • send administrative messages (for example, security updates or policy changes),
  • send marketing messages where permitted by law and based on your choices.

E. Advertising and measurement (where applicable)

  • measure ad performance and attribution,
  • show advertising within the Services or on third-party platforms (subject to platform rules and, where required, your consent).

F. Legal compliance

  • comply with legal obligations and respond to lawful requests,
  • protect our rights, users, and the public.

G. Aggregation and de-identification

We may aggregate or de-identify information so it can no longer reasonably identify you, and use it for analytics, research, and business purposes.


5. Legal Bases for Processing (EEA/UK and Similar Regions)

Where applicable law requires a legal basis, we process Personal Data under one or more of the following:

  • Contract: to provide the Services.
  • Legitimate interests: to operate, secure, improve, and market the Services, and to prevent abuse, provided those interests are not overridden by your rights.
  • Consent: where required (for example, certain advertising identifiers or permissions).
  • Legal obligation: to comply with law and lawful requests.

You can withdraw consent at any time where we rely on consent, but this does not affect processing that occurred before withdrawal.


6. How We Share Information

We may share information in the following circumstances.

A. Other users and the public

Some parts of the Services are social. If you publish a Situation or post content configured as public, other users (and potentially the public) may see:

  • your display name/username and profile photo (if set),
  • the Situation content you publish,
  • your messages and interactions within public Situations.

Please be careful what you share in public content.

B. Service providers

We use vendors to help provide and operate the Services, such as:

  • hosting and cloud infrastructure,
  • analytics and crash reporting,
  • customer support tools,
  • content moderation tools,
  • security and fraud prevention,
  • marketing and advertising technology providers.

These providers process information on our behalf under contractual obligations appropriate for their role.

C. Advertising and analytics partners

We may share device identifiers, advertising identifiers, IP address, and usage or attribution data with advertising and analytics partners to:

  • measure campaigns,
  • perform attribution,
  • deliver or optimize ads,

subject to applicable law and platform requirements.

D. Affiliates

We may share information with our affiliates and subsidiaries for purposes consistent with this Policy.

E. Legal and safety disclosures

We may disclose information if we believe in good faith that disclosure is necessary to:

  • comply with law, regulation, subpoena, court order, or lawful request,
  • investigate or enforce our Terms or policies,
  • detect or prevent fraud or security issues,
  • protect the rights, property, or safety of the Company, our users, or others.

F. Business transactions

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred as part of that transaction, subject to standard safeguards.

G. With your direction or consent

We may share information when you direct us to do so or when you provide consent.


7. AI, Chats, and Model Improvement

The Services include AI features that generate content based on inputs, including prompts and messages.

A. Processing chat content

We process prompts, messages, and related metadata to:

  • generate AI outputs,
  • provide the Services,
  • detect abuse and enforce policies,
  • improve reliability and user experience.

B. Use for improvement and development

We may use chat content and related data to improve and develop the Services, including quality and safety measures, such as:

  • evaluating model performance,
  • reducing harmful outputs,
  • improving moderation and detection.

Where required by law, we will obtain consent or provide additional choices.

C. Avoid sharing sensitive information

AI chats can be unpredictable. Do not include sensitive information (for example, government identifiers, precise financial account data, or private health details) in public Situations or anywhere you do not want it processed.


8. Your Rights and Choices

Your rights vary by location. Depending on where you live, you may have the right to:

  • Access: request a copy of Personal Data we hold about you.
  • Correction: correct inaccurate or incomplete Personal Data.
  • Deletion: request deletion of Personal Data, subject to legal exceptions.
  • Portability: receive certain data in a structured, commonly used, machine-readable format.
  • Objection: object to certain processing (for example, processing based on legitimate interests).
  • Restriction: restrict certain processing.
  • Withdraw consent: where processing is based on consent.
  • Opt out of targeted advertising: where applicable under local law.
  • Non-discrimination: not be discriminated against for exercising your rights.

Account deletion

You can delete your account in the app (if available) or by contacting us at team@onlywidget.com. We may retain certain information as required for legal compliance, security, or legitimate business purposes.

Marketing preferences

You can opt out of marketing emails by following the unsubscribe instructions. You may still receive non-marketing service messages (for example, security notices).

Advertising identifiers and tracking controls

You can often limit ad tracking via your device settings:

  • iOS: App Tracking Transparency and system privacy settings
  • Android: advertising ID controls

Browser-based “Do Not Track” signals are not consistently supported, and we may not respond to them.

How to exercise your rights

Email team@onlywidget.com with your request. We may need to verify your identity. If you use an authorized agent where permitted by law, we may request proof of authorization.

If you are in the EEA/UK, you may also lodge a complaint with your local data protection authority.


9. Data Retention

We retain Personal Data for as long as reasonably necessary for the purposes described in this Policy, including:

  • providing the Services,
  • safety and enforcement,
  • maintaining business records,
  • complying with legal obligations.

Retention periods vary depending on the type of data and the purpose.

Public Situations and community continuity: If a Situation you created was made available to others and has ongoing interactions, we may retain parts of that Situation and related Generated Content to preserve other users' experience, even if you delete your account, while taking reasonable steps to remove direct identifiers where feasible.


10. Security

We use reasonable technical and organizational safeguards designed to protect information from unauthorized access, disclosure, alteration, and destruction.

No system is perfectly secure. You use the Services at your own risk and should protect your account credentials.


11. International Data Transfers

We may process and store information in the United States and other countries where we or our service providers operate. These locations may have different data protection laws than your jurisdiction.

Where required, we use appropriate safeguards for cross-border transfers, such as contractual protections or adequacy mechanisms.

12. Children's Privacy

The Services are not directed to children under 13, and we do not knowingly collect Personal Data from children under 13. In the EEA/UK, users must generally be at least 16 (or as otherwise permitted by local law) to use the Services.

If you believe a child has provided us Personal Data, contact team@onlywidget.com and we will take appropriate steps.


13. Links to Third-Party Sites

The Services may include links to third-party sites or services. We are not responsible for their privacy practices. Review their policies before sharing information with them.


14. Changes to This Policy

We may update this Policy from time to time. The "Last Updated" date reflects the latest version. If we make material changes, we will provide notice through the app or other appropriate means.

Your continued use of the Services after changes become effective means you understand the updated Policy.
